SMS/MMS Mobile Message Marketing Program Terms and Conditions
Tomato Pie Pizza Joint (“Tomato Pie,” “we,” “us,” or “our”) offers a mobile messaging program (the “Program”), subject to these Terms and Conditions. By opting into or participating in the Program, you agree to these terms, including our Privacy Policy and the binding individual-only arbitration terms below. This Agreement applies solely to the Program.
1. User Opt-In
You may receive SMS or MMS marketing messages by opting into the Program (e.g., through online sign-up forms). By opting in, you consent to receive autodialed or prerecorded marketing messages to the number you provided. Consent is not required to purchase any goods or services. Message and data rates may apply. Message frequency varies. Reply HELP for help.
2. User Opt-Out
To stop receiving messages, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Tomato Pie message. You may receive one final confirmation message of your opt-out. Any other opt-out method (e.g., verbally asking an employee) is not considered valid.
3. Duty to Notify & Indemnify
If you discontinue or transfer your mobile number, you must complete the opt-out process first. Failure to do so may cause messages to reach someone else. You agree to indemnify and hold Tomato Pie harmless for claims or liabilities arising from your failure to notify us of a number change.
4. Program Description
Users who opt in may receive messages related to food, dining, and promotional offers.

Message and data rates may apply. Message frequency varies based on interaction.

8. Disclaimer of Warranty
The Program is provided “as-is.” We are not responsible for delayed or undelivered messages. Delivery depends on your wireless carrier.
9. Participant Requirements
You must have a text-enabled wireless device and a participating carrier. Not all carriers support this Program.
10. Age Restriction
You may not use or engage with the Program if under 13 years old. Users ages 13-17 must have parental or guardian permission.
11. Prohibited Content
You may not send or encourage content that is unlawful, harassing, defamatory, obscene, hateful, discriminatory, or otherwise prohibited by law. This includes, but is not limited to, content involving viruses, pirated software, or protected health information (HIPAA/HITECH).
12. Dispute Resolution
Any dispute between you and Tomato Pie Pizza Joint, or its service providers (including FoodTec Solutions, our POS and ordering provider), shall be resolved through binding arbitration in Los Angeles, California, under the Commercial Arbitration Rules of the American Arbitration Association (AAA).
The arbitrator shall apply federal law and the substantive laws of the Federal Judicial Circuit where Tomato Pie Pizza Joint’s principal place of business is located.
The parties waive the right to a jury trial or to participate in class or representative actions.
Each party bears its own costs unless otherwise ordered by the arbitrator.
This provision survives termination of the Program.
13. Miscellaneous
If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary. We may update these Terms occasionally; continued participation constitutes acceptance of any changes.
